Article 1 : Organising company
The company GEORGES MONIN SAS , with a capital stock of 568,000 €, whose registered office is 5 rue Ferdinand de Lesseps 18000 BOURGES France listed in the Bourges trade and companies register under the number n°57372137000019, is the organiser of a free contest with no obligation to purchase entitled “Instagram Online MONIN Cup 2018 Contest” from 11am on 9 December 2018 until midday on 13 December 2018 (known hereafter as the “Contest”). The Contest and its promotion are not managed and sponsored by Facebook. In this context, the Organiser does not hold Facebook responsible for any of the elements linked with this Contest, its organisation and its promotion.
Article 2 : Conditions of participation
The Contest is accessible on the MONIN Europe account : @monin_europe.
Participation in the Instagram MONIN Cup 2018 Contest is open to all individuals aged 18 or over throughout the world, with the exception of individuals working for the Organiser and those companies that have participated in the organisation of the Challenge as well as their close relatives (parents, brothers and sisters or any other person living in the same household).
All participation initiated with a temporary email address such as @yopmail.com, @jetable.net, @jetable.com, @jetable.org, @spambox.us will not be considered as valid and will be excluded. The Organiser reserves the right to exclude all participants not respecting the conditions of these rules.
It is strictly forbidden, by any means whatsoever, to modify or attempt to modify the proposed Contest mechanisms, including in order to modify the results or influence by an automated means or undermine the validity of the draw or the selection of a winner. If it is determined that a participant appears to have won a prize in contravention of the rules, by fraudulent means, such as an automated search or the use of an algorithm, or by other means other than those resulting from the process described by the Organiser in these rules, the prize concerned will not be attributed to him and will remain the property of the Organiser, without prejudice to any prosecution likely to be brought against the participant by the Organiser or by a third party.
Participation in the Challenge implies that all participants accept these rules entirely and without exception. Disrespecting the aforementioned rules will result in automatic exclusion from taking part and from the eventual awarding of prizes.
Article 3 : Terms of participation
To take part, the participant must connect to his/her Instagram account and access the MONIN Europe Instagram account on the following link : https://www.instagram.com/monin_europe/, from 11am on 9 December to midday on 13 December 2018.
Once on the Monin Europe Instagram account, the participant must vote for his/her favourite cocktail on the Instagram post published on 9 December at 11h00.
An Instagram account is only eligible to be entered once into the draw.
Any entries that are incomplete, incomprehensible, incorrect, presenting an anomaly, not conforming to the requirements of this rule or obviously fraudulent will not be taken into consideration. Furthermore, all attempt at fraud on behalf of the participant will result in the invalidity of all his/her participations in the Contest in its entirety.
The competitions shall be distributed as follows, throughout the month of December:
Article 4 : Prizes
- 1 prize « 1 Apple HomePod in Space Grey » worth 349 euros.
- 1 MONIN apron worth 54,54 euros
The value indicated for the prizes corresponds to the current or estimated recommended retail value including VAT at the date of publication of the rules, it is given for information purposes and is subject to variation.
Prizes are non-transferable, have no monetary value and cannot be substituted for a partial or complete reimbursement. Participants should be aware that the sale or exchange of prizes is strictly forbidden.
Article 5 : Designation of winners and prize giving
The draw will take place at the end of the competition on 13 December 2018 at 16h00. It will be overseen by the Organizing body MATTER, whose registered office is at 17-19 Rue des Jeuneurs, 75002 Paris.
The winner will be contacted in the following month by means of a message sent from the Monin Europe Instagram account. No email will be addressed to unsuccessful participants.
The winner should make contact with the Organiser by replying to the Instagram message and communicate his or her personal information for the organisational and management purposes of the Contest. The personal information collected concerning the winner include the following:
- First name
- Postal address
The winner agrees to any verification checks regarding his or her identity and residency.
Any winner who has not replied before the 25 January 2019 inclusive, will be considered as having purely and simply relinquished his prize.
The prizes will be sent to the winner between the 1 January 2019 and the 28 February 2019 by post. The Organising company shall not be held responsible in case of loss, damage or theft of the prize during delivery.
Article 6 : Disputes and responsibility
Participating in the contest implies the knowledge and acceptance of the characteristics and limitations of the Internet web, including where technical performances are concerned, the response time for consulting, interrogating or transferring information, the risks of interruption, the risks linked to the connection, the lack of protection against potential misappropriation of certain data and the risks of contamination by potential viruses circulating on the network. The Organiser cannot be held responsible, notably for the deficiencies that can affect the Internet, any problem of configuration or linked to a given browser.
The Organiser cannot guarantee that the Contest’s web site will function without interruption, that it doesn’t contain information errors nor that the defects found will be corrected.
The Organiser will not be held responsible in case of the technical malfunction of the Contest, if contestants are not able to connect to the Contest site or to participate, if the relative data for the participant is not captured for whatever reason for which it would not be held responsible (for example, an Internet connection problem due to any kind of reason at the user’s home) or it is illegible or impossible to process (for example, if the contestant possesses a computer device or inadequate software environment for his or her participation). Contestants will not be able to claim compensation in this respect.
In the same way, the Organiser will not be held responsible for any damage, material or immaterial caused by contestants, to their computer equipment and to data which is stored on there, or for any direct or indirect consequences which may result, including in relation to their personal, professional or commercial activity.
The Organiser will not incur any liability if, in the case of unavoidable circumstances or independent events beyond its control, it is forced to cancel the existing contest, to shorten it, to extend it, to delay it or to modify the conditions or the dates. Consequently, it could not be held responsible.
The Organiser is able to cancel all or part of the contest if it appears that fraudulent activities have taken place in any way whatsoever. It reserves, in this case, the right to not award prizes to fraudsters and/or to pursue the authors of these frauds before the relevant courts.
The Organiser reserves, in addition, the right to re-attribute all prizes that are not awarded, reclaimed or for which the initial winner has been excluded by reason of disrespect of the rules, of fraud, of a technical problem affecting the designation of winners or in the case of unavoidable circumstances.
The Organiser is released from any responsibility with regard to potential future disputes related to the modalities of attribution and making available the prizes.
The Organiser will not, moreover, be held responsible for sending of the prizes to an incorrect address due to the negligence of the winner. If the prizes are not able to be delivered to their destination for any reason whatsoever, beyond the control of the Organiser (the winner having moved without updating his address, etc….), they will remain definitively the property of the Organiser.
The winner undertakes not to hold the Organiser or its service-providers responsible as far as concerns the quality, the characteristics or the functioning of a product or service offered as a prize in the context of the challenge. The Organiser declines, moreover, any responsibility concerning accidents which might befall winners during the enjoyment of their prizes.
Finally, the Organiser reserves the right to resolve without appeal any difficulty that may arise concerning the interpretation or the application of these rules, on the understanding that no complaint will be accepted particularly on the modalities of the contest, the results, the prizes or their reception, one month after the end of the contest.
Article 7 : Consultation and modification of the rules
The rules are available on the site www.monin.com/fr/
No requests (written or verbal) will be answered concerning the interpretation or the application of the rules or the modalities and mechanics of the Contest.
Any cases not provided for by these rules will be decided by the Organiser.
The rules can be modified at any moment in the form of an amendment by the Organiser of this Contest.
Article 8 : Participation fees
The reimbursement of internet connection fees in order to participate in the Contest or to consult these rules, based on the fee of 3 minutes of internet connection at 0,20 €/minute or a total of 0,60 € or by means of a telephone line invoiced pro-rata to the time of communication or of the call, based on a corresponding rate to the connection cost of six minutes of local rate telephone communication from a fixed line, limited to a rate of 0,30 € can be obtained by sending a written request to the address of the Organiser (except for in the case of flat rate or unlimited access).
Postage fees will be reimbursed based on the current slow tariff by sending a written request submitted in the same letter and sent to the address of the Organiser enclosing the relevant bank details. No other fees will be reimbursed.
Article 9 : Intellectual property rights
The brands, logos, appearing on Instagram are the exclusive property of the owner GEORGES MONIN SAS and are protected by intellectual property rights. The use or reproduction, under any form whatsoever, is unauthorised without the permission of the owner.
Likewise, any reproduction or representation of all or part of the elements making up the challenge in any medium whatsoever, is expressly forbidden without the prior, written permission of GEORGES MONIN SAS.
Article 10 : Data privacy
Participants should know that the personal information, which is requested from them, is necessary for participation in the Instagram MONIN Cup 2018 Contest.
Conforming to the law « Informatique et Libertés » n° 78-17 of 6 January 1978 modified by the law of 6 August 2004, participants have a right to access, rectify and delete personal details concerning them.
Article 11 : Applicable law
The rules are subject to French law and any dispute will be raised in French law courts.
